{"id":9147,"date":"2025-06-25T08:26:04","date_gmt":"2025-06-25T06:26:04","guid":{"rendered":"https:\/\/academy.grainesdepaix.org\/ressources\/sexual-violence\/"},"modified":"2026-05-24T15:51:47","modified_gmt":"2026-05-24T13:51:47","slug":"sexual-violence","status":"publish","type":"ressource","link":"https:\/\/academy.grainesdepaix.org\/en\/ressources\/sexual-violence\/","title":{"rendered":"Sexual violence"},"content":{"rendered":"<div id=\"parent-fieldname-text\">\n<p>There is NO free consent if :<\/p>\n<ul>\n<li>\n<p>consent was not obtained: the person said NO<\/p>\n<\/li>\n<li>\n<p>consent is invalid:<\/p>\n<ul>\n<li>\n<p>the person is a child under the age of 16<\/p>\n<\/li>\n<li>\n<p>the person has given in out of fear (threats, strikes, climate of terror, etc.)<\/p>\n<\/li>\n<li>\n<p>the person is in a state of weakness (distress, disability, senility, etc.)<\/p>\n<\/li>\n<li>\n<p>the person is dependent on the perpetrator (boss, teacher, doctor, shrink, priest&#8230;)<\/p>\n<\/li>\n<li>\n<p>the person&#8217;s consciousness has been altered (by drugs, alcohol, medication, etc.)<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><i>Source : Sexual violence against women, what can we do? Violence is unacceptable,   <\/i>pp. 9 and 11<br \/><i>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;  brochure published in 2001 and reissued in 2010 by:<\/i><br \/><i>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;  &#8211; Service for the promotion of equality between men and women, State of Geneva<\/i><br \/>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;  &#8211; Center LAVI (reception center based on the Law on Assistance to Crime Victims)<br \/>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;  &#8211; Association Viol-Secours.<\/p>\n<p><b>There are three types of sexual violence:<\/b><\/p>\n<ul>\n<li>\n<p>with penetration or attempted penetration (1)<\/p>\n<\/li>\n<li>\n<p>with body contact (2)<\/p>\n<\/li>\n<li>\n<p>without body contact (3)<\/p>\n<\/li>\n<\/ul>\n<ol>\n<li>\n<p>vaginal, anal, oral &#8211; by penis, fingers, object (rape, sodomy, fellatio, sexual coercion)<br \/>\t&nbsp; &nbsp;<\/p>\n<\/li>\n<li>\n<p>touching, caressing, forced kissing, forced masturbation of the aggressor, obligation to assume degrading positions<br \/>\t&nbsp; &nbsp;<\/p>\n<\/li>\n<li>\n<p>exhibitionism, voyeurism, coercion to look at pornographic material, pornographic e-mails, sexual harassment, including sexual telephone calls, obscene words and gestures, vulgar remarks, sexist insults, unwelcome sexual proposals, filming or broadcasting images without the user&#8217;s knowledge, etc.<br \/>\t&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;<\/p>\n<\/li>\n<\/ol>\n<p><b>Sexual violence under the LAW :<\/b><\/p>\n<p>Each of these forms of sexual violence, including those committed against a wife by her partner (marital rape), are prohibited and punishable under the penal codes of various countries, including Switzerland:<br \/>&#8211; sexual violence of types (1) and (2) are prosecuted ex officio (with or without a complaint).<br \/>&#8211; sexual violence of type (3) is prosecuted either ex officio or on complaint, depending on the seriousness of the offence.<\/p>\n<p><i>Source: idem, pp. 9-10 (summary)<\/i><br \/><i>&nbsp; &nbsp; <\/i><\/p>\n<p><b>Other forms of sexual violence<\/b><\/p>\n<ul>\n<li>\n<p>Forced child marriages<\/p>\n<\/li>\n<li>\n<p>Child trafficking<\/p>\n<\/li>\n<\/ul>\n<p><i>Source: WHO &#8211; World report on violence and health: summary, 2002, p.13<\/i><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>There is NO free consent if : consent was not obtained: the person said NO consent is invalid: the person [&hellip;]<\/p>\n","protected":false},"featured_media":0,"template":"","tags":[],"ressources-theme":[],"category-ressources":[275],"class_list":["post-9147","ressource","type-ressource","status-publish","hentry","category-ressources-dictionary"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 -
